Can an H-1B alien intend to immigrate permanently to the U.S.?

Yes. An H-1B alien can be the beneficiary of an immigrant visa petition, apply for adjustment of status, or take other steps toward Lawful Permanent Resident status without affecting H-1B status. This is known as “dual intent” and has been recognized in the immigration law since passage of the Immigration Act of 1990. During the time that the application for LPR status is pending, an alien may travel on his or her H-1B visa rather than obtaining advance parole or requesting other advance permission from Immigration to return to the U.S.

The fact that there are a lot of people who wants to get absorbed into the USA system lawfully or unlawfully. USA system ensure better social security compared to third world countries. Plus any one who once become eligible for the benefits of social security etc, can go back to their less expensive countries and can have a lavish life.

It is necessary for a system to prevent such unhealthy trends.

And the priorities of the USA economy has changed during the last decade, as it can not afford to give higher salary to workers and compete in the world market. But it also need ‘restricted entry’ of skilled labour to ensure the smooth functioning of the business.

When one compain about delay etc, the questionis from which angle these things are viewed? From an individual’s perspective?

USA system, as we all know, was officially against illegal migrants coming from other countries and working there. But, infact, earlier, the authorities were knowingly encouraging the illegal migrant workers. This “double stand” exists everywhere. It is an open secret that the USA system would not have survived without the cheap labour available as migrant workers were ready to work accepting below ‘minimum wage’ and without healthinsurance protection etc.

But now it has become impossible for the system to survive so outsourcing is the brilliant strategy (from USA point of view) to overcome this problem. Without ‘cheap’ labour, it is not practical for the USA system to compete in the world market in many areas. There is a two line approach. First to ‘prevent’ the cheap labour entering to the system at any cost, thus force the domestic units to cut down the operations and persuade them to go out. Second is to encourage outsourcing and ensure the cheap labour available elsewhere. That is to create “satelite economies” like India.

For any system, survival of the system is most important. So rules are made and conveniently bent to suit this. The strict Visa rules and outsourcing are meant to protect USA system (read corporate). What ever I and you protest and weep is not going to change the USA priorities. It has become a fashion to abuse Bush and call him idiot. But it is better to understand that Bush family is very close to CIA and they understand and represent the USA (corporate) interest better than others. The tightening of the VISA rules has nothing to do with WTO attack. A significant section actually think WTO attackwas just a stage drama to prepare the ground for a “U turn” in economic strategy and to take the business go to “cheap labour” instead of encouraging the “cheap labour” reach USA business.

There is no point applying the same rules against USA visitors to other third world countries. Third world countries’ system is different from USA system, so it needs a different approach.
