What to Do After You Apply For the Eb5 Immigrant Program

If you have applied for an eb5 visa, you likely already know the basics. In fact, hopefully you have an immigration lawyer to guide you through the process. Either way, you might have questions about what to do now. Know what to expect while you wait to find out if you were accepted into the eb5 immigrant program.

You are probably excited to find out the answer for sure. After all, this will be a big move from your home country to the United States, and you will need to plan long before the move. While you wait, you should try to figure out where you want to live. If you applied to a regional center, you will probably have the option to live nearby or far away. If you do not want to have daily involvement, you can live across the country from the center. You will still receive updates about the project in which you invested money. If you have family coming with you to the United States, you should talk to them about the decision. Consider what area of the country you might prefer, taking into consideration population, culture, schools, and weather. 

While you make such decisions, you should know how long you will likely be kept waiting to hear the decision. The whole process usually takes about a year to a year and a half, so expect to wait awhile before finding out your status. Be sure to stay in contact with your immigration lawyer during the time so that you are available to answer any questions about yourself should they come up while your application is being processed. Your attorney can also answer any questions you might have, as well. 

Look ahead to the future so that you know what to expect. If you do qualify for the eb5 immigrant pathway to the United States, you will have a conditional resident visa for up to two years. During this time, the USCIS will ensure that you have met the requirements of the program, such as creating ten full-time jobs. Once this is determined after about 24 months, you will receive a Green Card. Your lawyer will keep you apprised of deadlines, but know that you will need to apply for the Green Card 90 days before your two years on the conditional resident visa are up.

While this might seem like a long time to wait, consider the other ways to get into the United States. Most of them require immigrants to get on a long waiting list and take several tests. Instead, you can use the eb5 immigrant program to get into the country with your family within a year and a half. If you add up the period of time you will wait for your application to be approved, you could be a U.S. permanent resident within about three to four years, which is a great deal.
